Court Upholds Ruling That LNG Exports from Cove Point Terminal Are Permissible
On Friday, the Maryland Court of Special Appeals upheld a lower court ruling that exports of LNG from the Dominion Cove Point LNG (DCP) terminal in Lusby, Md., are permitted under a 2005 agreement between Sierra Club, Maryland Conservation Counsel Inc. and DCP. Sierra Club challenged DCP’s assertion that the agreement, which restricts the use of the Cove Point terminal, permits the exportation of natural gas. The Court declined to address Sierra Club’s additional argument that there are undue environmental impacts from the export project, ruling that the issue will be reviewed by governmental agencies having subject jurisdiction.
