Sierra Club Withdraws Court Challenge to LNG Exports
Law360 reports that the U.S. Court of Appeals for the D.C. Circuit has granted Sierra Club’s voluntary motion to dismiss its appeal of U.S. Department of Energy (DOE) orders approving LNG export volumes for Cheniere Energy Inc.’s Sabine Pass LNG project in Cameron Parish, La. Sierra Club lost several court cases where it challenged FERC orders approving the construction of various LNG export terminals and DOE orders approving the export of the LNG produced at the terminals. Sierra Club’s primary argument was that “the agencies failed to analyze the environmental impacts of increased gas drilling that would result from more LNG exports.” The report notes that Sierra Club’s voluntary dismissal “seem[s] to close the book on legal fights over the DOE’s export decisions.”
