BP Energy Files Appeal of FERC Orders Authorizing Dominion Cove Point LNG Export Project
BP Energy has filed a petition for review of FERC’s orders authorizing construction and operation of the Dominion Cove Point LNG (DCP) export terminal in Lusby, Md. BP Energy filed the petition in the U.S. Court of Appeals for the D.C. Circuit to challenge orders in which FERC determined that DCP did not unduly discriminate against BP Energy by not offering BP Energy the same opportunity to turnback its DCP terminal capacity as DCP had offered to Statoil Natural Gas (Statoil) since BP Energy and Statoil were not “similarly situated.” An appeal by Earth Reports, Inc., et al. on environmental issues raised in the same FERC orders is also pending in the same court.
