Federal Magistrate Recommends Partial Summary Judgment in Favor of Oregon LNG in Suit Against Port of Astoria
Federal Magistrate Judge John Jelderks issued a recommendation this week to grant Oregon LNG’s motion for partial summary judgment in the terminal developer’s ongoing lawsuit against the Port of Astoria. Oregon LNG’s lawsuit alleges that the Port breached its agreement to extend the Port’s land lease with the State of Oregon for thirty years if Oregon LNG exercised its option to extend its sublease of the land for the same term. The magistrate’s recommendation is available in the PACER system under Docket No. 09-847-JE and The Oregonian offers additional coverage.
In the same article in The Oregonian, the newspaper reports that the office of Oregon Gov. Ted Kulongoski has decided not to investigate how the annual lease price for the Oregon LNG site was determined.
