Secretary of Commerce Stays Closure of Broadwater Energy’s Appeal of New York State’s CZMA Consistency Objection
The National Oceanic and Atmospheric Administration (NOAA) announced in today’s Federal Register that the Secretary of Commerce has stayed the closure of the decision record for Broadwater Energy’s appeal of the New York State Department of State’s objection to the LNG regasification terminal proposed for Long Island Sound in order to solicit more information on the issue. Under the Coastal Zone Management Act (CZMA), the Secretary of Commerce can override New York’s objection to the project by finding that “the project is consistent with the objectives or purposes of the CZMA or otherwise necessary in the interest of national security.” The decision record will close on February 13, 2009.
