Appeals Court: City Gave Sufficient Public Notice About Pelican Island LNG
Yesterday a Texas appeals court overturned a state district court decision that held that public notice for a meeting to consider lease terms for the Pelican Island LNG terminal proposed by BP was insufficient. The ruling states that although the initial meeting and approval of the lease were not properly noticed, the final lease terms were approved at a properly-noticed meeting. An attorney for the appellee told The Daily News (Galveston, Texas) that he expected his client to pursue a rehearing by the full appeals court or an appeal to the Texas Supreme Court.
