Federal Court Upholds Zoning Amendment Prohibiting LNG Terminals in Sensitive Coastal Areas
A U.S. District Court on Friday upheld an amendment to the Baltimore County Zoning Regulations that prohibits the construction of LNG terminals in environmentally sensitive coastal areas of Chesapeake Bay. In its opinion, the Court said that the amendment “is not preempted by the Natural Gas Act and is within the delegated authority of the State of Maryland and Baltimore County under the Coastal Zone Management Act.” The Baltimore Sun reports that a spokesperson for AES, the developer of the proposed Sparrows Point LNG terminal, said that the company is considering an appeal of the ruling and is “determined to press forward on this.”
