FERC Denies Rehearing on Smaller Vessels for Fall River Terminal

FERC issued an order yesterday denying the requests for rehearing filed by the Conservation Law Foundation and the City of Fall River in the Weaver’s Cove LNG proceeding.  At issue was the Commission’s April 17, 2006 order stating that the Weaver’s Cove plan to use smaller vessels in order to allow passage under the old Brightman Street Bridge did not materially alter the project.  Fall River and the Conservation Law Foundation had argued that further environmental analyses and public interest reviews were necessary to evaluate the use of smaller ships.  The Commission noted that the issue is now before the Coast Guard; should Coast Guard find that the vessel size changes the nature of the project approved by FERC, additional review by the Commission would be warranted.
