Passamaquoddy Tribe Prevails in Freedom of Access Case

The Maine Supreme Court yesterday ruled that the state’s Freedom of Access Act does not require the Passamaquoddy Tribe to disclose information about its negotiations with Quoddy Bay LNG.The Supreme Court agreed with the lower court thatthe tribe was acting as a business rather than a municipality when it negotiated with Quoddy Bay and, therefore, should not be subject to the open access law.
