Judge Nullifies Agreement in BP’s Pelican Island Project
The Galveston Daily News today reports that a judge has voided the 2004 agreement between BP, Galveston City Council and the Wharves Board of Trustees because inadequate notice violated the Texas Open Meetings Act. Judge John Ellisor did not invalidate BP’s later, separate lease-option agreement made with the Wharves Board only, but that deal reportedly requires a City Council commitment to honor the lease. Further, plaintiff Nancy Saint-Paul’s attorney, Mark Stevens, said that “Without the city, I don’t think the wharves can do the deal.” A successful lease agreement would secure a location for BP’s proposed Pelican Island LNG terminal.
