Weaver’s Cove Files Petition with NOAA for Rhode Island Coastal Zone Ruling
On December 16, Weaver’s Cove filed with NOAA requesting the agency issue an interpretation of its regulations with regard to the Rhode Island Coastal Resources Management Council’s alleged failure to process a federal coastal zone consistency certification for the proposed LNG terminal in Fall River, Mass. Weaver’s Cove argues that the failure to issue a decision within six months of certification means that the federal consistency is “conclusively presumed” pursuant to the CZMA. RICRMC has argued previously that the Weaver’s Cove certification is incomplete, and that therefore the six month clock has not begun.
